These Terms govern the mutual rights and obligations of the parties arising from the purchase contract concluded between the Seller and the buyer through the online shop, in accordance with Czech Act No. 89/2012 Coll., the Civil Code. Where the buyer is a consumer, the relationship is also governed by Act No. 634/1992 Coll., on Consumer Protection.
The presentation of goods is informative. The buyer places an order by adding goods to the cart and submitting it, having the option to review and change the details beforehand. The purchase contract is concluded when the Seller confirms receipt of the order by e‑mail. Orders and confirmations are delivered electronically.
Prices are shown for each item and are final; the Seller is not a VAT payer. Shipping and packaging costs are displayed in the cart before the order is completed. Payment is processed via a payment gateway (provided by Shopify and its payment partners); the price is due upon completion of the order unless stated otherwise. A tax document is provided electronically.
Goods are delivered by a contracted carrier to the address provided by the buyer. Delivery time and shipping price depend on the options chosen at checkout and are shown in the cart. The risk of damage passes to the buyer upon receipt of the goods; where the buyer is a consumer, upon the consumer taking receipt.
A consumer has the right to withdraw from the contract without giving a reason within 14 days of receiving the goods (Section 1829 of the Civil Code). It is sufficient to send the withdrawal to info@still-form.art within that period. The goods must be returned within 14 days of withdrawal; the buyer bears the cost of return. The Seller refunds the received payment within 14 days. The right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalised (e.g. made‑to‑order works or products). Choosing a standard size or motif from the range is not personalisation; for standard-size goods the right of withdrawal applies even where the item was printed to order.
Rights from defective performance are governed by Sections 2099 et seq. and 2165 et seq. of the Civil Code. Complaints may be made by e‑mail to info@still-form.art with a description of the defect. Consumer complaints are handled without undue delay, at the latest within 30 days unless agreed otherwise. Ceramics are handmade: each piece is unique and may vary in shape, colour or glaze and show minor imperfections; such natural variations are characteristic of handmade production and are not defects.
Original artworks offered through the STILLFORM platform are generally sold on individual enquiry and by separate agreement; sale terms, shipping, insurance and payment are then arranged individually.
The competent body for out‑of‑court resolution of consumer disputes is the Czech Trade Inspection Authority (www.coi.cz). Consumers may also use the EU online dispute resolution platform at ec.europa.eu/consumers/odr.
The processing of personal data is described in a separate Privacy Policy. These Terms may be amended; the version in force at the time an order is submitted applies to that order. The relationship is governed by the law of the Czech Republic. The Czech version of these Terms is authoritative; other language versions are provided for convenience.

Tyto obchodní podmínky upravují v souladu s § 1751 odst. 1 zákona č. 89/2012 Sb., občanský zákoník, vzájemná práva a povinnosti smluvních stran vzniklé v souvislosti s kupní smlouvou uzavíranou mezi prodávajícím a kupujícím prostřednictvím internetového obchodu. Je-li kupujícím spotřebitel, řídí se vztahy rovněž zákonem č. 634/1992 Sb., o ochraně spotřebitele.
Prezentace zboží v internetovém obchodě má informativní charakter. Kupující vytváří objednávku vložením zboží do košíku a jejím odesláním. Před odesláním má možnost zkontrolovat a měnit údaje. Kupní smlouva je uzavřena okamžikem, kdy prodávající kupujícímu potvrdí přijetí objednávky e‑mailem. Objednávka a její potvrzení jsou prodávajícímu i kupujícímu doručovány elektronicky.
Ceny zboží jsou uvedeny u jednotlivých položek a jsou konečné; prodávající není plátcem DPH. Náklady na dopravu a balné jsou zobrazeny v košíku před dokončením objednávky. Platba probíhá prostřednictvím platební brány (poskytovatel Shopify a jeho platební partneři); kupní cena je splatná při dokončení objednávky, není‑li uvedeno jinak. Daňový doklad obdrží kupující elektronicky.
Zboží je dodáváno prostřednictvím smluvního přepravce na adresu uvedenou kupujícím. Dodací lhůta a cena dopravy se řídí možnostmi zvolenými v objednávce a jsou uvedeny v košíku. Nebezpečí škody na zboží přechází na kupujícího převzetím zboží; je‑li kupujícím spotřebitel, přechází nebezpečí okamžikem převzetí zboží spotřebitelem.
Spotřebitel má právo odstoupit od kupní smlouvy bez udání důvodu ve lhůtě 14 dnů ode dne převzetí zboží (§ 1829 občanského zákoníku). Odstoupení postačí odeslat na info@still-form.art v uvedené lhůtě. Zboží kupující vrátí nejpozději do 14 dnů od odstoupení; náklady na vrácení zboží nese kupující. Prodávající vrátí přijaté peněžní prostředky do 14 dnů. Právo na odstoupení se nevztahuje na zboží upravené podle přání spotřebitele nebo pro jeho osobu (např. díla či produkty zhotovené na zakázku). Výběr standardní velikosti nebo motivu z nabídky se za úpravu na míru nepovažuje; u zboží ve standardních velikostech právo na odstoupení trvá i tehdy, bylo-li potištěno až po objednávce.
Práva a povinnosti z vadného plnění se řídí § 2099 a násl. a § 2165 a násl. občanského zákoníku. Spotřebitel je oprávněn uplatnit právo z vady v zákonné lhůtě. Reklamaci lze uplatnit e‑mailem na info@still-form.art s popisem vady. Prodávající vyřídí reklamaci spotřebitele bez zbytečného odkladu, nejpozději do 30 dnů, není‑li dohodnuto jinak. Keramika je ruční prací: každý kus je originál a může se lišit tvarem, barvou či glazurou a nést drobné nedokonalosti; tyto přirozené odchylky jsou znakem ruční výroby a nejsou vadou.
Originální umělecká díla nabízená prostřednictvím platformy STILLFORM jsou zpravidla prodávána na základě individuální poptávky a samostatné dohody; podmínky prodeje, doprava, pojištění a platba jsou v takovém případě sjednány individuálně.
K mimosoudnímu řešení spotřebitelských sporů je příslušná Česká obchodní inspekce (www.coi.cz). Spotřebitel může využít rovněž platformu pro řešení sporů online na adrese ec.europa.eu/consumers/odr.
Zpracování osobních údajů se řídí samostatným dokumentem Ochrana osobních údajů. Tyto podmínky lze měnit; pro danou objednávku platí znění účinné v okamžiku jejího odeslání. Vztahy se řídí právem České republiky. Rozhodné znění těchto podmínek je české; jazykové verze slouží pro usnadnění.

Diese AGB regeln die gegenseitigen Rechte und Pflichten aus dem zwischen dem Verkäufer und dem Käufer über den Online‑Shop geschlossenen Kaufvertrag gemäß dem tschechischen Gesetz Nr. 89/2012 Slg. (Bürgerliches Gesetzbuch). Ist der Käufer Verbraucher, gilt zusätzlich das Gesetz Nr. 634/1992 Slg. über den Verbraucherschutz.
Die Warendarstellung ist informativ. Der Käufer erstellt die Bestellung, indem er Waren in den Warenkorb legt und absendet; zuvor kann er die Angaben prüfen und ändern. Der Kaufvertrag kommt zustande, sobald der Verkäufer den Eingang der Bestellung per E‑Mail bestätigt. Bestellungen und Bestätigungen werden elektronisch übermittelt.
Die Preise sind je Position Endpreise; der Verkäufer ist kein Umsatzsteuerzahler. Versand‑ und Verpackungskosten werden vor Abschluss im Warenkorb angezeigt. Die Zahlung erfolgt über einen Zahlungsdienstleister (Shopify und dessen Zahlungspartner); der Kaufpreis ist mit Abschluss der Bestellung fällig, sofern nichts anderes angegeben ist. Der Beleg wird elektronisch bereitgestellt.
Die Ware wird durch ein Vertragsversandunternehmen an die vom Käufer angegebene Adresse geliefert. Lieferzeit und Versandkosten richten sich nach der im Bestellvorgang gewählten Option und werden im Warenkorb angezeigt. Die Gefahr geht mit Übernahme der Ware auf den Käufer über; beim Verbraucher mit dessen Übernahme.
Ein Verbraucher kann den Vertrag ohne Angabe von Gründen innerhalb von 14 Tagen ab Erhalt der Ware widerrufen (§ 1829 BGB‑CZ). Es genügt, den Widerruf innerhalb dieser Frist an info@still-form.art zu senden. Die Ware ist binnen 14 Tagen nach Widerruf zurückzusenden; die Rücksendekosten trägt der Käufer. Der Verkäufer erstattet den Betrag innerhalb von 14 Tagen. Kein Widerrufsrecht besteht bei nach Kundenwunsch angefertigter oder personalisierter Ware (z. B. Auftragsarbeiten). Die Wahl einer Standardgröße oder eines Standardmotivs gilt nicht als Anfertigung nach Maß; bei Ware in Standardgrößen besteht das Widerrufsrecht auch dann, wenn sie erst nach Bestellung bedruckt wurde.
Die Mängelrechte richten sich nach §§ 2099 ff. und 2165 ff. BGB‑CZ. Reklamationen können per E‑Mail an info@still-form.art mit Mangelbeschreibung erfolgen. Verbraucherreklamationen werden ohne unnötigen Aufschub, spätestens innerhalb von 30 Tagen, bearbeitet, sofern nichts anderes vereinbart ist. Keramik ist Handarbeit: Jedes Stück ist ein Unikat und kann in Form, Farbe oder Glasur variieren und kleine Unregelmäßigkeiten aufweisen; solche natürlichen Abweichungen sind Merkmal der Handarbeit und kein Mangel.
Über die Plattform STILLFORM angebotene Originalkunstwerke werden in der Regel auf individuelle Anfrage und per gesonderter Vereinbarung verkauft; Verkaufsbedingungen, Versand, Versicherung und Zahlung werden dann individuell vereinbart.
Zuständig für die außergerichtliche Beilegung von Verbraucherstreitigkeiten ist die Tschechische Handelsinspektion (www.coi.cz). Verbraucher können auch die EU‑Plattform zur Online‑Streitbeilegung unter ec.europa.eu/consumers/odr nutzen.
Die Verarbeitung personenbezogener Daten ist in der gesonderten Datenschutzerklärung beschrieben. Diese AGB können geändert werden; für eine Bestellung gilt die bei ihrer Absendung geltende Fassung. Es gilt das Recht der Tschechischen Republik. Maßgeblich ist die tschechische Fassung; die Sprachfassungen dienen der Erleichterung.

I prodotti sono consegnati tramite corriere convenzionato all’indirizzo indicato dall’acquirente. Tempi e costi di spedizione dipendono dall’opzione scelta e sono mostrati nel carrello. Il rischio passa all’acquirente con la ricezione dei prodotti; per il consumatore, al momento della presa in consegna.
Il consumatore può recedere dal contratto senza motivazione entro 14 giorni dal ricevimento dei prodotti (§ 1829 del Codice civile). È sufficiente inviare il recesso a info@still-form.art entro tale termine. I prodotti vanno restituiti entro 14 giorni dal recesso; le spese di restituzione sono a carico dell’acquirente. Il Venditore rimborsa entro 14 giorni. Il recesso non si applica ai prodotti realizzati su misura o personalizzati (es. opere o prodotti su ordinazione). La scelta di una taglia o di un motivo standard non è una personalizzazione; per i prodotti in taglie standard il diritto di recesso sussiste anche se stampati su ordinazione.
I diritti per difetti sono disciplinati dagli artt. 2099 e segg. e 2165 e segg. del Codice civile. I reclami possono essere inviati via e‑mail a info@still-form.art con descrizione del difetto. I reclami dei consumatori sono gestiti senza indebito ritardo, al più tardi entro 30 giorni, salvo diverso accordo. La ceramica è fatta a mano: ogni pezzo è unico e può variare per forma, colore o smalto e presentare piccole imperfezioni; tali variazioni naturali sono caratteristiche della lavorazione artigianale e non costituiscono un difetto.
Le opere d’arte originali offerte tramite la piattaforma STILLFORM sono generalmente vendute su richiesta individuale e con accordo separato; condizioni di vendita, spedizione, assicurazione e pagamento sono in tal caso concordati individualmente.
L’organo competente per la risoluzione extragiudiziale delle controversie dei consumatori è l’Ispettorato commerciale ceco (www.coi.cz). I consumatori possono usare anche la piattaforma UE di risoluzione online su ec.europa.eu/consumers/odr.
Il trattamento dei dati personali è descritto nella Informativa sulla privacy. I presenti Termini possono essere modificati; all’ordine si applica la versione in vigore al momento dell’invio. Si applica il diritto della Repubblica Ceca. La versione ceca è quella autentica; le altre versioni linguistiche sono fornite per comodità.

Estos Términos regulan los derechos y obligaciones recíprocos de las partes derivados del contrato de compraventa celebrado entre el Vendedor y el comprador a través de la tienda en línea, de conformidad con la Ley checa n.º 89/2012 Coll., el Código Civil. Cuando el comprador es un consumidor, la relación se rige también por la Ley n.º 634/1992 Coll., de protección del consumidor.
La presentación de los productos tiene carácter informativo. El comprador realiza un pedido añadiendo productos al carrito y enviándolo, con la posibilidad de revisar y modificar los datos previamente. El contrato de compraventa se celebra cuando el Vendedor confirma la recepción del pedido por correo electrónico. Los pedidos y las confirmaciones se envían electrónicamente.
Los precios se indican para cada artículo y son definitivos; el Vendedor no es sujeto pasivo de IVA. Los gastos de envío y embalaje se muestran en el carrito antes de finalizar el pedido. El pago se procesa a través de una pasarela de pago (proporcionada por Shopify y sus socios de pago); el precio es exigible al finalizar el pedido, salvo que se indique lo contrario. El documento fiscal se entrega electrónicamente.
Los productos se entregan mediante un transportista contratado en la dirección facilitada por el comprador. El plazo de entrega y el precio del envío dependen de las opciones elegidas al finalizar la compra y se muestran en el carrito. El riesgo de daño se transmite al comprador en el momento de la recepción de los productos; cuando el comprador es un consumidor, cuando este toma posesión de ellos.
El consumidor tiene derecho a desistir del contrato sin indicar motivo en un plazo de 14 días desde la recepción de los productos (artículo 1829 del Código Civil). Basta con enviar el desistimiento a info@still-form.art dentro de ese plazo. Los productos deben devolverse en un plazo de 14 días desde el desistimiento; el comprador asume los gastos de devolución. El Vendedor reembolsa el pago recibido en un plazo de 14 días. El derecho de desistimiento no se aplica a los productos fabricados según las especificaciones del consumidor o claramente personalizados (p. ej. obras o productos hechos por encargo). Elegir una talla o un motivo estándar del catálogo no es personalización; para los productos de talla estándar, el derecho de desistimiento se aplica incluso cuando el artículo se haya impreso por encargo.
Los derechos derivados del cumplimiento defectuoso se rigen por los artículos 2099 y siguientes y 2165 y siguientes del Código Civil. Las reclamaciones pueden presentarse por correo electrónico a info@still-form.art con una descripción del defecto. Las reclamaciones de los consumidores se tramitan sin demora indebida, a más tardar en un plazo de 30 días, salvo acuerdo en contrario. La cerámica está hecha a mano: cada pieza es única y puede variar en forma, color o esmalte y presentar pequeñas imperfecciones; estas variaciones naturales son propias de la producción artesanal y no constituyen defectos.
Las obras de arte originales ofrecidas a través de la plataforma STILLFORM se venden, por lo general, previa consulta individual y mediante acuerdo aparte; las condiciones de venta, el envío, el seguro y el pago se acuerdan entonces de forma individual.
El organismo competente para la resolución extrajudicial de litigios de consumo es la Autoridad Checa de Inspección Comercial (www.coi.cz). Los consumidores también pueden utilizar la plataforma europea de resolución de litigios en línea en ec.europa.eu/consumers/odr.
El tratamiento de los datos personales se describe en una Política de privacidad aparte. Estos Términos pueden modificarse; a cada pedido se le aplica la versión vigente en el momento de su envío. La relación se rige por el derecho de la República Checa. La versión checa de estos Términos es la auténtica; las versiones en otros idiomas se ofrecen por comodidad.
